Terms of Service

These draft Terms govern your use of Headshotist, an online service that turns user-provided photos into AI-generated professional headshots. By using the service, you agree to these Terms. If you do not agree, do not use Headshotist.

You may need to sign in with Google to generate or access headshots. You are responsible for keeping your Google account secure, providing accurate information, and for activity performed through your Headshotist account. You must be legally able to enter into these Terms.

Headshotist sells prepaid credit packs through Stripe. Prices, taxes, included credits, and the number of credits required for a generation are shown before purchase or use. Credits are not cash, cannot be transferred, and have no monetary value outside Headshotist. Unless required by law, unused credits are not redeemable for cash.

Generated images are created by automated AI systems. Results may contain inaccuracies, artefacts, unexpected details, or similarities to other content. You must review every output before publishing or relying on it.

Headshotist does not guarantee an exact likeness, a particular style, uninterrupted processing, or that an output will be suitable for any specific platform, job application, identity document, or professional purpose.

You keep your rights in photos you upload. You grant Headshotist and its processing providers a limited, worldwide licence to host, copy, process, modify, and transmit those photos only as needed to operate, secure, improve, and support the service. You confirm that you own the photos or have permission from every identifiable person to upload and process them.

You must not use Headshotist to:

• upload a person's image without appropriate permission;
• impersonate, deceive, defraud, harass, exploit, or defame anyone;
• create unlawful, abusive, sexual, hateful, or privacy-invasive material;
• misrepresent an AI-generated image as an official identity document or verified evidence;
• probe, disrupt, reverse engineer, or misuse the service or another user's account.

Subject to applicable law, third-party rights, and these Terms, you may use the outputs generated for you for personal and commercial purposes. Because laws concerning AI-generated material vary, Headshotist cannot promise that copyright or other exclusive rights will arise in an output.

Headshotist and its licensors retain all rights in the service, software, branding, interface, templates, and other materials we provide, excluding your uploaded photos and your rights in generated outputs. These Terms do not permit copying or reselling the service itself.

We may maintain, update, change, suspend, or discontinue parts of Headshotist. Processing times are estimates, and availability may depend on third-party providers. We will try to give reasonable notice of material changes when practical, but we do not promise uninterrupted or error-free service.

You may stop using Headshotist at any time. We may restrict or terminate access when we reasonably believe these Terms were breached, the service or another person is at risk, payment is disputed or fraudulent, or the law requires it. The provisions that should reasonably survive termination will remain in effect.

To the maximum extent allowed by law, Headshotist is provided “as is” and “as available.” [Insert legal business name] will not be liable for indirect, incidental, special, consequential, or lost-profit damages. Any total liability arising from the service will be limited to the amount you paid Headshotist in the 12 months before the claim. Nothing here excludes liability or consumer rights that cannot legally be excluded.
